Municipal Consent Application

Overview

A consent application is required when any work is completed within the Township of Selwyn's Right-of-Way (ROW). The ROW includes the roadway surface, gravel or paved shoulders, sidewalks, curb and open ditches. The Township of Selwyn may only grant municipal consent within our ROW: we do not have the authority to grant consent for Provincial, County or Private ROW. Before submitting your application you must ensure that you are applying to the correct agency. Application fees are non-refundable.

Terms and Conditions

  1. Consent application, supporting documents and application fee must be received at least ten (10) business days prior to the schedules work. 
  2. There is a fee associated with the issuance of a consent application. For payment options, please see the general receivables section of our payment options
  3. Every Applicant shall abide and adhere to any applicable Law, By-Law or Standard that may apply to an excavation or activity to be performed by the applicant within a Township of Selwyn road allowance.
  4. The Applicant shall, prior to the commencement of any work, obtain utility locates from all owners of Utilities and shall comply with any instructions from the utility Owners when working in proximity to their utilities.
  5. The Applicant shall provide written notice to the following parties at least 48 hours prior to the commencement of work if a road or lane closure is permitted. The written notice shall include a contact name and phone number, anticipated duration of the project and when clean up and restoration will be completed. All road or lane closures must first be approved by the Township and shall be conspicuously posted five (5) working days in advance of the commencement of work stating the date and duration of the closure. Parties: 
    • Township of Selwyn;
    • All Owners of utilities in the road allowance;
    • Adjacent property owners and businesses;
    • All Transit Authorities; and
    • all Emergency Services.
  6. Every Applicant to whom a consent has been granted shall ensure that access for emergency vehicles to all public and private properties is available at any and all times. 
  7. Pavement reinstatement shall be completed in accordance with applicable Ontario Provincial Standard Drawing (OPSD), unless noted otherwise by the Township of Selwyn Manager of Public Works.

  8. The Applicant agrees that the Township of Selwyn has the right to perform any necessary remedial work during the construction or Warranty Period caused by the Applicant's operation subject to the following conditions: 
    • The Township of Selwyn will give the Applicant not less than 24 hours notice of any remedial work required, unless conditions call for immediate attention.
    • If at the expiration of the time allowed the Applicant or it’s Contractor has not commenced remedial work to the satisfaction of the Township of Selwyn, the Township may undertake to have the remedial work completed by whatever means it deems necessary; and
    • The Applicant agrees to reimburse the Township of Selwyn for all costs involved.
  9. The Consent is valid for twelve (12) months from the Approval Date and is subject to cancellation at any time without notice. If the work has not commented within twelve (12) months of the issuance of the Consent, the Applicant shall apply for an extension of the Consent. When an extension is required, the Applicant shall apply for such extension at least 24 hours in advance of the stated date of completion on this Consent. The Township of Selwyn must authorize time extensions before taking effect and failure to comply will render this Consent void.
  10. This Consent is not valid unless approved by the Township of Selwyn and all approvals required under Local, Provincial or Federal legislation have been obtained by the Applicant.
  11. Any Consent issued by the Manager of Public Works may be revoked upon giving written notice to the Applicant.
  12. Applications will not be considered unless the following requirements are met:
    • Include detailed design drawings in PDF format. Red line mark-up required in PDF and CAD format within 6 months of completion.
    • Include a Traffic Control Plan that meets Ontario Traffic Manual (OTM) Book 7.
    • Attach a copy of Certificate of Insurance (minimum $5 million) covering Road Cut/Occupancy and naming the Corporation of the Township of Selwyn as an “Additional Insured”.
    • Attach a copy of proof of registration with the Workplace Safety Insurance Board (WSIB).
    • Payment of Application Fee.
  13. All excess soil, with the exception of granular material, must remain onsite within 100 metres of the work zone.

Insurance

The Corporation of the Township of Selwyn requires the applicant to provide a Certificate of Insurance (attached hereto and forming part of this application), including:

Commercial General Liability

The Applicant shall, at their own expense, obtain and maintain comprehensive Commercial General Liability Insurance, underwritten by an insurer licensed to conduct business in the Province of Ontario, for a limit of not less than $5 Million per occurrence, an aggregate limit of not less than $10 Million, within any policy year with respect to completed operations and a deductible of not more than $25,000. The policy shall include an extension for a standard provincial and territorial form of non-owned automobile liability policy. This policy shall include but not be limited to:

  • Commercial General Liability insurance with a minimum limit of protection of $5 million per occurrence
  • The Corporation of the Township of Selwyn named as an Additional Insured
  • Occurrence
  • Bodily Injury and Property Damage Liability
  • Products and/or Completed Operations
  • Employers’ Liability
  • Personal Injury Liability
  • Tenants’ legal Liability
  • Professional / Malpractice Liability
  • Cross Liability and Severability of Interest
  • Blanket Contractual
  • Work performed on behalf of the Named Insured by sub-contractors

Professional Liability Insurance

The Applicant shall take out and keep in force Professional Liability insurance in the amount of $5 Million providing coverage for acts, errors and omissions arising from their professional services performed under this Agreement. The policy SIR/deductible shall not exceed $25,000 per claim and if the policy has an aggregate limit, the amount of the aggregate shall be double the required per claim limit. The policy shall be underwritten by an insurer licensed to conduct business in the Province of Ontario and acceptable to The Corporation of the Township of Selwyn.  The policy shall be renewed for 3 years after contract termination.  A certificate of insurance evidencing renewal is to be provided each and every year.  If the policy is to be cancelled or non-renewed for any reason, 90-day notice of said cancellation or non-renewal must be provided to The Corporation of the Township of Selwyn. The Corporation of the Township of Selwyn has the right to request that an Extended Reporting Endorsement be purchased by the Applicant at the Applicant’s sole expense.

Environmental Impairment Liability Insurance

The Applicant shall carry an Environmental Impairment Liability Policy, underwritten by an insurer licensed to conduct business in the Province of Ontario for a limit of not less than $5 Million.   Coverage shall include bodily injury, property damage, clean-up and remediation costs. 

Indemnification and Hold-Harmless

The Applicant shall defend, indemnify and save harmless The Corporation of the Township of Selwyn its elected officials, officers, employees and agents from and against any and all claims of any nature, actions, causes of action, losses, expenses, fines, costs (including legal costs), interest or damages of every nature and kind whatsoever, including but not limited to bodily injury, sickness, disease or death or to damage to or destruction of tangible property including loss of revenue or incurred expense resulting from disruption of service, arising out of or allegedly attributable to the negligence, acts, errors, omissions, misfeasance, nonfeasance, fraud or willful misconduct of the Applicant, its directors, officers, employees, agents, contractors and subcontractors, or any of them, in connection with or in any way related to the delivery or performance of this Contract. This indemnity shall be in addition to and not in lieu of any insurance to be provided by the Applicant in accordance with this Contract and shall survive this Contract.

The Applicant agrees to defend, indemnify and save harmless The Corporation of the Township of Selwyn from and against any and all claims of any nature, actions, causes of action, losses, expenses, fines, costs (including legal costs), interest or damages of every nature and kind whatsoever arising out of or related to the Applicant’s status with WSIB. This indemnity shall be in addition to and not in lieu of any proof of WSIB status and compliance to be provided by the Supplier in accordance with this Contract, and shall survive this Contract.

Information Collection Notice

Information collected on this form will be used by the Township for the purposes of processing and circulating for review the work proposed by the applicant within the Township of Selwyn’s right-of-way as part of the approval of the location of the applicant’s infrastructure within the Township’s right of way. Any questions about this form may be directed to the Clerk.

Review Process

When you click submit, you will receive a copy of this application for your records and a copy will be sent to the Finance Department for invoice creation. When the non-refundable fee has been received, the application will be sent to the Manager of Public Works for review.

When the Township review is complete, you will receive a response from the Manager of Public Works.
